The Law

Schools must offer supporting measures (individualized services to restore or preserve equal access, protect safety, deter sexual harassment) to every alleged victim of sexual harassment.

“Sexual harassment” is an unlawful form of sex discrimination and includes sexual assault, dating violence, domestic violence, and stalking (as determined by a reasonable person to be so severe, pervasive, and objectively offensive that it effectively denies a person equal access to educational programming or activity). 

A school district is obligated to respond when: (1) the school has actual knowledge of sexual harassment; (2) that occurred within the school’s own “education program or activity”; (3) against a “person in the United States.”

 “Actual knowledge” includes that of any school employee

Any individual in the school district community (victim or a third party) may report allegations at any time and through any means that will result in the school district’s Title IX coordinator’s receipt

"School District Community" means individuals subject to the control and supervision of the Board including, but not limited to, students, teachers, staff, volunteers, and Board members.

"Third party" means individuals outside the School District community who participate in school activities and events authorized by the Board including, but not limited to educational service center employees, visiting speakers, participants on opposing athletic teams, and vendors doing business with, or seeking to do business with, the District.

A school district must proceed with its grievance process for every formal complaint of sexual harassment and must respond meaningfully/offer supporting measures to every alleged victim of sexual harassment.

School districts must utilize a grievance process in handling complaints of sexual harassment under the new Title IX Regulations that incorporate due process, fair treatment of all parties, and result in reliable and responsible determination.

 

Compliance 

Wayne Local Schools complies with all Federal laws and regulations prohibiting discrimination. 

The Wayne Local Schools Board of Education is currently adopting updated board policy regarding Title IX compliance and procedures.

 

Education

School personnel are trained in Title IX using materials from Public School Works https://corp.publicschoolworks.com/

Employees have Title IX information in their employee handbook.

Students have age appropriate Title IX information in their student handbook.

 

Reporting

School Districts that receive federal funds must designate at least one Title IX compliance coordinator.
